Stop Lender Abuse Programs

A frequent client of ours is a real estate investment and property management company by the name of US Residential. They have pioneered a couple of unique programs that are helping many to get out from under the burdens of over-leveraged real estate.

These programs are different from one another in substantial ways, but are identical in one important characteristic: For each program, we are retained by the homeowner to aggressively litigate and negotiate a settlement with the bank for each property.

The two programs include:

The Walk-Away SLAP

This program is ideal for the property owner who is not living in the home or who is willing to vacate the home. Once enrolled in the program, property owners allow US Residential to manage the property (they still own the property). We are then hired to aggressively litigate on the homeowner’s behalf. Our goal is to seek a settlement with the bank.

There is a small retainer needed to enroll in the program, but US Residential assumes the responsibility of paying us our monthly fees to litigate. In effect, after the initial retainer is paid, property owners are able to simply “walk away” with the peace of mind to knowing that the property is being managed, it’s bills are being paid, and work is under way to reach a settlement.

Once a settlement is reached, an investor provides the capital to satisfy the settlement and the home is resold. The property owner receives a percentage of the profit from the sale, which allows for the possibility of recouping a small portion of the investment in the property.

The Owner-Occupied SLAP

This program is ideal for the person, or family, who is faced with losing their home, investment, credit, and piece of mind, but need more time in the home before moving. In this program, we litigate on behalf of the homeowner and seek to arrive at a settlement with the bank in exchange for a greatly reduced retainer and monthly fees. This process can take months, or even years, during which time the homeowners continue to live in the property.

Once a settlement is reached, an investor from US Residential provides the capital to satisfy the settlement and the home is resold. The homeowner receives a percentage of the profit from the sale, which allows for the possibility of recouping a small portion of the investment in the property and may provide much needed cash for re-establishing themselves
